Spodbujanje enakopravnosti in preprečevanje diskriminacije je široko polje delovanja v okviru varovanja človekovih pravic. V okviru spodbujanja enakopravnosti in preprečevanja diskriminacije pod delo Zagovornika načela enakosti spadajo različne dejavnosti. V okviru organizacijske strukture so dejavnosti razdeljene na več delovnih sklopov.

Najobsežnejši delovni sklop zajema beleženje, opazovanje in spremljanje diskriminacije. Pod ta sklop spada:

  • Notranja statistika organa, poizvedbe, svetovanja, pomoč, podpora, spremljanje medijev, prejete pobude, vprašanja ipd
  • Spremljanje dela inšpekcij in analiza 
  • Spremljanje diskriminacije, kakor jo obravnavajo in zaznavajo drugi državni organi
  • Spremljanje in beleženje preventivnih ukrepov s strani subjektov spremljanja 
  • Preučevanje obstoječih in novih zakonodajnih postopkov – podajanje mnenj (po vsebinah in učinkih)
  • Beleženje dela Evropskega sodišča za človekove pravice in mednarodne sodne prakse
  • Pristopanja k in izvajanje obveznosti po mednarodnih pogodbah, sporazumih in konvencijah, zbirka opažanj in tem
  • Spremljanje tem (okoliščine, področja, oblike)

Drugi sklopi se navezujejo na:

  • raziskave in poizvedbe po osebnih okoliščinah, področjih in oblikah diskriminacije ter druge povezane raziskave (javnomnenjske)
  • vzpostavitev in ohranjanje dialoga s ključnimi nevladnimi organizacijami ter diskriminiranimi skupinami in z državnimi institucijami
  • priprava mnenj in priporočil glede na različne dele in teme beleženja. Upoštevajoč raziskave, analize in evalvacije spremljanih podatkov in procesov ter dobrih praks, in iz prejetih primerov. Pod ta sklop se uvrščajo tudi predlogi sprejetja posebnih ukrepov (pozitivna diskriminacija)
  • ozaveščanje splošne javnosti in skupin po osebnih okoliščinah, področjih in oblikah diskriminacije z namenom preventive in odprave diskriminacije ter nestrpnosti in spodbujanje raznolikosti ter dobrih odnosov med različnimi skupinami v družbi.
  • izobraževanje splošne javnosti in skupin po osebnih okoliščinah, področjih in oblikah diskriminacije in po subjektih ter skupinah.
  • sodelovanje
  • mednarodno sodelovanje in izmenjava v okviru Equineta, Sveta Evrope, Evropske komisije, Agencija Evropske unije za temeljne pravice (FRA), Organizacije združenih narodov (OZN), diplomatskih predstavništev in bilateralnega sodelovanja.
  • izdelava rednih in posebnih poročil

Za uspeh pri doseganju teh nalog in ciljev je ključno dobro sodelovanje z državnimi organi, nosilci javnih pooblastil, inšpektorati ter z drugimi samostojnimi državnimi organi. Potreben je tudi aktiven dialog z nevladnimi organizacijami, civilno družbo ter z lokalnimi skupnostmi pri odkrivanju neenakopravnosti in sodelovanju za odpravo različnih oblik diskriminacije v vsakdanjem življenju. 

Za razumevanje koncepta načela enakosti in pomena odpravljanja diskriminacije je potrebno pridobivati in vzdrževati širšo javnomnenjsko podporo kot tudi sodelovanje ključnih oblikovalcev javnega mnenja. Tako Zagovornik načela enakosti poskuša spodbujati enakopravnost s pomočjo ustreznega sistema izobraževanja, informiranja in ozaveščanja.

In its Article 1, the Law on Protection against Discrimination stipulates the purpose of the Law, which is protection of each individual against discrimination regardless of gender, nationality, race or ethnic origin, language, religion or belief, disability, age, sexual orientation, gender identity and sexual expression, social status, financial status, education or any other personal circumstance. Personal circumstances which may form the basis for discrimination are, in addition to the above-mentioned, also pregnancy, parenthood, health status, skin colour, etc.

The Law provides protection against discrimination due to different personal circumstances in areas of social life, in realizing the human rights and fundamental freedoms, in enforcing rights and liabilities and in other legal relationships on political, economic, social, cultural, civil or any other field.

Anyone who believes that they have experienced discrimination can submit a request to address the discrimination with the Advocate of the Principle of Equality HERE (currently only in Slovenian).

The Advocate of the Principle of Equality offers independent help to victims of discrimination, namely in the form of aid when taking initiatives; information about discrimination and legal protection against discrimination; advice and legal assistance in exercising individual rights in connection with protection against discrimination in procedures associated with discrimination (e.g. what legal means are available to an individual and how to use them before other state authorities, etc.).

In specific cases, the Advocate of the Principle of Equality may also represent a discriminated person in judicial proceedings or accompany them in judicial proceedings when a discriminated person authorises him or consents to it. The Advocate of the Principle of Equality decides on whether he will participate in a judicial proceeding in a particular case particularly given: his strategic priorities, the nature of the case, his personnel and financial resources, and the findings in the specific case of determining discrimination. The Advocate of the Principle of Equality evaluates the latter for each individual case.

In accordance with the Law on Protection against Discrimination, the Advocate of the Principle of Equality leads proceedings to identify discrimination and performs certain tasks of inspection over the implementation of this Law.

The Advocate of the Principle of Equality starts the procedure of identifying discrimination on the basis of an initiative of a discriminated person, but can also be done ex officio if he is notified about the existence of discrimination on the basis of an anonymous request, the request of a third party or any other way.

The Advocate of the Principle of Equality and competent inspection services perform inspection over implementation of provisions of the Law on Protection against Discrimination and other laws on the prohibition of individual forms of discrimination.

After performing the inspection, the Advocate of the Principle of Equality may issue a decision to eliminate irregularities identified during the inspection; propose adoption of appropriate measures to prevent further discrimination or to eliminate the consequences of discrimination, and prohibit further discrimination. If he judges that issuing a decision would not be reasonable, he may immediately assign the case to a competent inspection service to start relevant procedures against the offender.

If the Advocate of the Principle of Equality estimates that a law or any other regulation is discriminatory, he may request a procedure for review of constitutionality and legality of a regulation or general act issued for the exercise of public powers, or may inform the person proposing a procedure for review of constitutionality and legality.

The initiative to begin a proceeding for the review of constitutionality of a regulation is a legal remedy, which in the proceedings before the Constitutional Court enforces the inconsistency between the act and the Constitution, or the inconsistency between an implementing regulation or general act issued for the exercise of public powers and the Constitution or law.
